{"id":922,"date":"2019-08-21T04:50:18","date_gmt":"2019-08-21T04:50:18","guid":{"rendered":"http:\/\/blog.certifiedfinancialguardian.com\/?p=922"},"modified":"2019-08-29T05:32:35","modified_gmt":"2019-08-29T05:32:35","slug":"another-step-from-sebi-to-safeguard-the-interest-of-mutual-fund-investors","status":"publish","type":"post","link":"https:\/\/blog.certifiedfinancialguardian.com\/index.php\/2019\/08\/21\/another-step-from-sebi-to-safeguard-the-interest-of-mutual-fund-investors\/","title":{"rendered":"Another Step From SEBI To Safeguard The Interest Of Mutual Fund Investors"},"content":{"rendered":"\n<p>Ever&nbsp;since credit rating downgrades exposed investors in debt mutual funds to high risk, including the ones who had parked money in liquid funds, the capital market regulator has been on the vigil.<\/p>\n\n\n\n<p>A need was felt to review the regulatory framework and take necessary steps to safeguard the interest of investors and maintain the orderliness and robustness of mutual funds.<\/p>\n\n\n\n<p>Moving further in that direction, recently, vide a&nbsp;<a href=\"https:\/\/www.sebi.gov.in\/legal\/circulars\/aug-2019\/parking-of-funds-in-short-term-deposits-of-scheduled-commercial-banks-by-mutual-funds-pending-deployment_43923.html\" target=\"_blank\" rel=\"noreferrer noopener\">circular dated August 16, 2019<\/a>, the Securities and Exchange Board of India (SEBI) has restrained mutual fund houses or Asset Management Companies (AMCs) from parking the assets of a scheme in Short Term Deposits (STDs) of a bank which has invested in the scheme.<\/p>\n\n\n\n<p style=\"text-align:left; color: #4e81c8; padding: 0px 50px 0px 50px;\"><em><strong>&#8230;It is clarified that Trustees\/Asset Management Companies (AMCs) shall ensure that no funds of a scheme is parked in STD of a bank which has invested in that scheme. &#8211;&nbsp;<a href=\"https:\/\/www.sebi.gov.in\/legal\/circulars\/aug-2019\/parking-of-funds-in-short-term-deposits-of-scheduled-commercial-banks-by-mutual-funds-pending-deployment_43923.html\" target=\"_blank\" rel=\"noreferrer noopener\">SEBI Circular (SEBI\/HO\/IMD\/DF4\/CIR\/P\/2019\/093)<\/a><\/strong><\/em><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img src=\"https:\/\/data.personalfn.com\/images\/article-iamge.jpg\" alt=\"article-image\"\/><\/figure><\/div>\n\n\n\n<p style=\"font-size:12px;text-align:center\">(Image source: pixabay.com; photo credit: succo)<\/p>\n\n\n\n<p>What&#8217;s more?<\/p>\n\n\n\n<p>The capital market regulator has even asked AMCs to make sure that the bank in which the scheme has an STD does not invest in the respective scheme until the scheme has an STD with such a bank.<\/p>\n\n\n\n<p style=\"text-align:left; color: #4e81c8; padding: 0px 50px 0px 50px;\"><strong><em>Trustees\/AMCs shall also ensure that the bank in which a scheme has STD do not invest in the said scheme until the scheme has STD with such bank.&nbsp;<a href=\"https:\/\/www.sebi.gov.in\/legal\/circulars\/aug-2019\/parking-of-funds-in-short-term-deposits-of-scheduled-commercial-banks-by-mutual-funds-pending-deployment_43923.html\" target=\"_blank\" rel=\"noreferrer noopener\">&#8211; SEBI Circular (SEBI\/HO\/IMD\/DF4\/CIR\/P\/2019\/093)<\/a><\/em><\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><strong>The objective&#8230;<\/strong><\/p>\n\n\n\n<p>This is been done to protect the interest of investors in the securities market from related party transactions, whereby the vested interest of parties shall be done away with, and at the same time promote the development of securities market at large.<\/p>\n\n\n\n<p>In the past, too, the capital regulator has taken a number of measures in the interest of investors such as:<\/p>\n\n\n\n<ul><li><p>Ban on entry load (in August 2009)<\/p><\/li><li><p><a rel=\"noreferrer noopener\" href=\"https:\/\/www.personalfn.com\/fns\/sebis-new-mutual-fund-commission--disclosure-norms-the-impact-on-ifas\" target=\"_blank\">Ban on upfront commission and new commission disclosure norms<\/a><\/p><\/li><li><p>Uniform fact sheets<\/p><\/li><li><p>Made mutual fund houses apply product labels with colour codes and&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.personalfn.com\/fns\/why-you-should-not-look-at-the-risk-o-meter-when-investing-in-mutual-funds-\" target=\"_blank\">risk-o-meter<\/a><\/p><\/li><li><p><a rel=\"noreferrer noopener\" href=\"https:\/\/www.personalfn.com\/fns\/good-news-your-cost-of-investing-in-mutual-funds-to-come-down\" target=\"_blank\">Revised the expense ratio<\/a>, bringing down the cost of investing<\/p><\/li><li><p>Introduction of&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.personalfn.com\/guide\/direct-mutual-fund\" target=\"_blank\">Direct Plan<\/a>&nbsp;for a mutual fund scheme<\/p><\/li><li><p><a rel=\"noreferrer noopener\" href=\"https:\/\/www.personalfn.com\/guide\/mutual-fund-scheme-renamed\" target=\"_blank\">Categorization and Rationalization of Mutual Fund Schemes<\/a><\/p><\/li><li><p><a rel=\"noreferrer noopener\" href=\"https:\/\/www.personalfn.com\/fns\/how-sebis-new-norms-for--debt-mutual-funds-make-a-high-impact\" target=\"_blank\">Prudential norms governing liquid funds and other debt &amp; money market instruments<\/a><\/p><\/li><li><p><a rel=\"noreferrer noopener\" href=\"https:\/\/www.personalfn.com\/fns\/graded-exit-load-on-liquid-funds\" target=\"_blank\">Graded exit load for liquid funds<\/a><\/p><\/li><li><p>Changed&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.personalfn.com\/fns\/new-valuation-norms-for-debt-mutual-funds-and-impact-on-investments\" target=\"_blank\">valuation norms for below-investment grade securities<\/a><\/p><\/li><li><p>Asked&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.personalfn.com\/fns\/heres-why-sebi-wants-mutual-funds-to-invest-in-listed-securities\" target=\"_blank\">mutual fund houses to shift all their investment to listed or to-be-listed equity and debt securities<\/a>&nbsp;in a phased manner and reduce their exposure to unrated debt instruments from 25% to just 5%<\/p><\/li><li><p>And even&nbsp;<a href=\"https:\/\/www.personalfn.com\/fns\/will-rating-reform-make-investing-in-debt-mutual-funds-safe\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">pulled up credit rating agencies<\/a>&nbsp;for their high laxity and&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.sebi.gov.in\/legal\/circulars\/jun-2019\/guidelines-for-enhanced-disclosures-by-credit-rating-agencies-cras-_43268.html\" target=\"_blank\">enhanced their disclosure norms<\/a>&nbsp;<\/p><\/li><\/ul>\n\n\n\n<p>[<strong>Read:<\/strong>&nbsp;<a href=\"https:\/\/www.personalfn.com\/fns\/should-rating-agencies-be-blamed-for-credit-crisis\" target=\"_blank\" rel=\"noreferrer noopener\">Should The Rating Agencies Be Blamed For This Credit Crisis?<\/a>]<\/p>\n\n\n\n<p>Post the&nbsp;<a href=\"https:\/\/www.personalfn.com\/fns\/how-ilfs-rating-downgrade-will-impact-your-mutual-funds\" target=\"_blank\" rel=\"noreferrer noopener\">IL&amp;FS<\/a>,&nbsp;<a href=\"https:\/\/www.personalfn.com\/fns\/how-is-dhfls-interest-delay-impacting-your-debt-mutual-funds\" target=\"_blank\" rel=\"noreferrer noopener\">DHFL<\/a>,&nbsp;<a href=\"https:\/\/www.personalfn.com\/fns\/defaulting-adag-companies-could-hit-investors-hard\" target=\"_blank\" rel=\"noreferrer noopener\">Reliance ADAG<\/a>, and Essel Group debt episodes, SEBI has moved swiftly taking a number of measures vide the necessary diktats and guidelines in an effort to ensure that the Indian mutual fund industry follows the best practices weighing the undercurrents.<\/p>\n\n\n\n<p><strong>Summing up&#8230;<\/strong><\/p>\n\n\n\n<p>The continual refining of risk management framework by the capital market regulator, learning from experiences on the ground, is very welcome and worth appreciating. It will tighten the grip on mutual funds; make mutual fund houses more accountable for their actions, and in turn, get them to fall in line so that the interest of investors&#8217; is safeguarded and it boosts their confidence.<\/p>\n\n\n\n<p><em>Advice for investors&#8230;<\/em><\/p>\n\n\n\n<p>While the capital regulator is doing its best to protect your interest, do not assume debt funds to be safe. Remember,&nbsp;<a href=\"https:\/\/www.personalfn.com\/fns\/is-your-investment-in-debt-mutual-fund-at-risk\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">investing in debt funds is not risk-free<\/a>.<\/p>\n\n\n\n<p>[<strong>Read:<\/strong>&nbsp;<a href=\"https:\/\/www.personalfn.com\/fns\/are-you-holding-debt-mutual-funds-with-stressed-assets\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Are You Holding Debt Mutual Funds With Stressed Assets?<\/a>]<\/p>\n\n\n\n<p><a href=\"https:\/\/www.personalfn.com\/fns\/approach-debt-funds-with-your-eyes-wide-open\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Approach even short-term debt funds with your eyes wide open<\/a>&nbsp;and pay attention to the portfolio characteristics and quality of the scheme. The fact is many debt funds across maturity profiles already have exposure to downgraded and toxic debt papers, which heightens the investment risk.<\/p>\n\n\n\n<p>So, prefer safety of principal over return.
